Courts and Government terms resume
In Spain, the state of alarm declared by Royal Decree 463/2020, of March 14, suspended all administrative and judicial terms, as well as the statute of limitations.
By Resolution of May 20, 2020, of the Congress of Deputies, the State of Alarm is extended until June 6 inclusive. However, administrative, judicial and civil terms and deadlines are reopening.
As regards judicial procedures, the suspension is lifted from June 4, 2020. Nevertheless, we have to point out that, pursuant to the provisions of article 2 of Royal Decree-Law 16/2020, the suspended judicial procedural deadlines will be computed from the beginning, the first business day being the next business day after the one in which the suspension of the corresponding procedure ceases to take effect (June 4) . In addition, the deadlines to file appeals against judgments notified during the suspension or even in the 20 working days afterwards are doubled.
Relating to administrative or governmental procedures, with effect from June 1, 2020, the computation of the terms that had been suspended will be resumed. Although they could be restarted, as judicial procedure terms, should a law so states.
STATUTE OF LIMITATIONS AND EXPIRY
With effect from June 4, 2020, terms regarding statute of limitation or expiration of rights and actions, will be resumed.
